Terms and Conditions
Bill Free Homes will provide services as selected on this agreement, known as SERVICES.
1. By completing our agreement you (the signatories) agree to be bound by these terms and conditions.
2a. You agree to pay Bill Free Homes (through the letting agent if applicable) the service charge for the property as set out on the Property Addition Form in return for BILL FREE HOMES paying all SERVICES to this property during the term of this agreement. This agreement does not cover charges for non-standard services unless previously agreed with BILL FREE HOMES in writing.
2b. You agree to be jointly and severally liable for all payments received as part of this agreement. Payments received separately will be debited as a whole from the total amount outstanding regardless of amount paid and from whom. If the amount received each month does not cover the total amount due then you and the property will be in arrears, jointly and severally.
2c. If the property is in arrears for more than 30 days BILL FREE HOMES reserves the right to cancel this agreement.
3. If you receive any bills or letters from the SERVICE companies once your service has been connected then you agree to immediately forward them on to BILL FREE HOMES , Wesley House Rennies Lane Durham DH1 2JD or the Letting Agent (as applicable) so that they can be dealt with.
4. You acknowledge that the service charge is payable by you in consideration of BILL FREE HOMES agreeing to pay for all mains gas, electricity and water consumed by the property (subject to the right of cancellation in respect of excessive usage in clause 9): a. up to the amount of the service charge; and b. in excess of such amount. Accordingly, if the total charges for all mains gas, electricity and water used by the property is less than the service charge, the difference between the service charge and the total charges is paid by you to BILL FREE HOMES in consideration of BILL FREE HOMES assuming full responsibility to pay for all mains gas, electricity and water used by the property (subject to clause 9), and BILL FREE HOMES assuming the risk that the total charges for mains gas, electricity and water may exceed the amount of the service charge.
5. BILL FREE HOMES agrees that the charges for all mains gas, electricity and water used by the property and comprised in the service charge will not at any time exceed the maximum amounts permitted for the re-sale of such services as determined by OFGEM and OFWAT.
6. BILL FREE HOMES or the Letting Agent (as applicable) has the power to cancel this agreement at anytime and for whatever reason on one months written notice to you. If, after signing this agreement, BILL FREE HOMES or the Letting Agent (as applicable) finds that any of the information you have supplied is false or deliberately misleading, Bill Free Homes may cancel your agreement from that day on and all monies received up to that date will be retained. A replacement utility company will be chosen by BILL FREE HOMES and asked to supply your property with their utility services from that point on.
7.You are prohibited from changing utility or phone suppliers either voluntarily or if canvassed by a supplier.
8. BILL FREE HOMES reserve the right to cancel the SERVICE supply at any time if payment is not made by the specified date.
9. In line with our Fair Usage Policy, maximum usage is deemed to be 1.5 times the average persons usage (as defined by Ofgem as 27.4 KWh of gas, 4.25 KWh of electricity and 0.5 cubic meters of water per day). If you exceed this maximum usage we reserve the right to cancel the service agreement.
10. The charge quoted includes VAT at the current prevailing rate.
11. You are entitled to terminate this agreement at any time on one months notice to BILL FREE HOMES or the Letting Agent (as applicable), subject to a minimum 6 months service supply.
12. You agree to allow BILL FREE HOMES or the Letting Agent (as applicable) or one of its representatives on reasonable notice into the property to read your gas, electricity or water meter(s).
13. You agree to let BILL FREE HOMES contact your current and future utility suppliers, the Letting Agent (if applicable) and your landlord, and, if asked, will provide BILL FREE HOMES with a copy of your tenancy agreement.
14. BILL FREE HOMES may require you to provide mains gas, electricity and water (if applicable) meter readings. If BILL FREE HOMES don't receive them when asked, Bill Free Homes may cancel this agreement.
15a. On signing this agreement, it is your responsibility to inform BILL FREE HOMES or the Letting Agent (as applicable) if there is a pre-pay meter at the property. Once BILL FREE HOMES or the Letting Agent has been informed of the meters existence, BILL FREE HOMES or the Letting Agent will write to you giving details of when the meters are to be exchanged to conventional ones. This can take up to three months.
15b. It is your responsibility to make arrangements for the provision of access onto the property on the agreed date for the relevant utility company representative, in order to make the exchange.
15c. It is your responsibility to ensure that permission from the landlord / agent prior to signing this agreement to convert any pre-pay meters at the property to a conventional meter has been granted. BILL FREE HOMES or the Letting Agent (as applicable) accepts no liability with regard to landlords in this matter.
15d. Maintenance of pre-pay meters is the responsibility of the tenant and BILL FREE HOMES accept no responsibility for debt or crediting these meters and cannot guarantee exchange or resetting of these meters. You will only be charged for the services connected to conventional meters. Once a conventional meter is in place you will charged the full amount of the service charge.
15e. If you do not inform BILL FREE HOMES of the existence of any pre-pay meters until after the start of your service agreement or you do not request that the service charge be reduced, you will be billed the full amount of the service charge but will be entitled to a refund in accordance with clause 15d. upto a minimum of 30 days.
16. BILL FREE HOMES only agrees to pay all the charges for mains gas, electricity and water for the property if there is only one meter for each service per agreement. If the property has more than one meter for mains gas, electricity or water, you must inform BILL FREE HOMES. If you would like to convert the property to one meter for each service, this is your responsibility.
17. The utility meters and associated service supply equipment remain the property of the utility companies and / or utility suppliers. If any damage at any time is caused to this equipment the costs incurred by BILL FREE HOMES from the owners of this equipment will be your responsibility.
18. If BILL FREE HOMES are charged for extra services which are not part of the standard services (see clause 2) we reserve the right to pass these charges on to the relevant party.
19. BILL FREE HOMES accepts no responsibility for installation or re-connection of utility meters.
20. BILL FREE HOMES reserve the right to change utility supplier and will at our discretion unless informed otherwise.
21. You agree that all hardware supplied to the property in respect to the SERVICES provided remains the property of BILL FREE HOMES. At the end of the agreement period this hardware will be returned in reasonable condition, subject to fair wear and tear. Failure to do this will result in compensation being sought, recoverable via the deposit/bond being held by your Letting Agent/Landlord if applicable. We may ask for a deposit if signing up to the service directly with BILL FREE HOMES.
